My understanding is that if DOJ is going to investigate a candidate for president or vice-president, then the probe has to be approved by the attorney general. Seems reasonable to me, considering the sensitivity.

There's no prohibition against investigating someone who is campaigning, though investigations would be briefly suspended around Election Day. This isn't new policy, just a continuation of what previous attorneys general have followed.

I think Rachel made a bigger deal out of this than warranted.

Former federal and state prosecutor Elie Honig wrote a "note" back in May about the timeline for charging tfg. I'm not sure if this "pause to prosecute" applies even if he were to announce his intention today to run for president in 2024.

"Midterm elections are on November 8th. The Justice Department has a longstanding policy against announcing new criminal charges or taking overt investigative steps (such as executing a search warrant) shortly before an election. There’s no formal provision on the books, but AGs of both parties over the past several administrations have issued Department-wide memos reminding prosecutors to abide by this blackout practice, which applies either 60 days or 90 days before an election, depending who you ask. (I always understood the blackout period to be 60 days, but other DOJ alums place the line of demarcation 90 days out.) "

Huh. Sure didn't stop FBI Director Comey from announcing in October 2016 that he was looking into Clinton's emails. Garland needs to leave the 19th and 20th Centuries. We are in desperate times.

I read the article, Lynell. It is very discouraging, really. I do, however see a comparison of the hare and the turtle, Garland being the latter. Maybe he will prevail (here’s hoping 🙏).

Yes, I find it discouraging, too, Marlene. Article was written back in May, when I thought there was still hope. Now, two months later, and nothing, nada, zip. I have been in his corner all this time but now feel he really needs to get a move on!

Remember way back in 2020 when other than COVID all we had to contend with was getting 45 out of the WH? How quaint those days were!😵‍💫

I think he is so isolated that he simply does not realize his silence is causing tremendous anxiety and disillusion for us who want justice.
