They were right to do that, since Kavanaugh said if the issue of ex-president's access to executive privilege had been brought up, he'd have given it to Trump. But still, 8-1 against him is good.
But that's just the point. Trump's not the party requesting records. He's resisting disclosure on the basis of a privilege he had before he left office. He has no residual claim to a privilege he no longer has.The privilege belongs to the incumbent officeholder, not Trump. I thought that the DC Circuit made that crystal clear.
I listened to a Lawfare podcast that said an ex president DOES have some residual right to privilege, albeit very limited, and the SC decision doesn’t truly settle this question once and for all.
Don't believe it. That's a lot of 'wistful' ('coulda, woulda, shoulda') thinking. Anything a former official gets is a courtesy, and not by way of right. When it comes down to cases, the facts matter more than the doctrine. Trump's acolytes are engaging in a form of jesuidical thinking, actually dissembling by implying something that really isn't there, a conflating of the formerly high office with an implicit claim that the honorific title of 'former president' is entitled to more than he was due. Trump disgraced himself and his office by his misconduct, and that, in and of itself, is sufficient to negate any sense of obligation that might be thought to be due him as a former president.
Well, TC, if this is so, I suppose we should be relieved that the 6 "scumbags" are still expecting Trump's lawyers to make acceptable presentations. The real tests will come when the FBI begins arresting Trump's lawyers and the other treasonous facilitators. The sooner the better.

Arthur, Trump is a long schooled in his own privilege and believes strongly in it.
So, he asserts it all of the time. He was and remains, privileged by birth.
Just ask him.
They did, for which they should be complimented. which was why the Supremes couldn't "work their magic."

They're right.

Right.
