We would have seen summaries of testimony or possibly transcripts but not the testimony itself because the judge precluded cameras in the courtroom. It’s my understanding that a jury decision in Dominion’s favor could award money but not require actions by FNC beyond paying the amount decided. Furthermore, amounts awarded by juries are often reduced by judges, either in the trial court or an appeals court to an amount commensurate with damages. Since $787M is roughly ten times the value of Dominion, as a business, a $1.6B judgment might well have been reduced to a tenth of $786M or less. Finally, it’s my understanding that judges almost always press for settlements. The judge did us the favor of ruling FNC’s statements about the election as falsehoods, and Dominion forced FNC to acknowledge that as part of the settlement.
