Unless, of course, a blue wave Congress creates a new Federal Law Review Court to take over being the final court for reviewing federal laws. Constitutionally, the Congress has the power to do that. The Supreme Court would be limited to the cases in which the Constitution gives it "original jurisdiction" - which would be more in line with the "originalist" views of its majority. This new court could then be set up better, with its 9 justices serving staggered 18 year terms. Pres.Biden would have to nominate an initial set of justices who would have varying length terms, from 2 years to 18 years.

I'd be interested in how a blue DOJ might take a position on Court cases that are obviously "ginned up" in order to attack legislation.
