We have a fight to do. We are supported by the courts. Trump is big on stupid antics with no basis. He wants to see if you will buy it. We did buy the National Emergencies Act invocation. A big mistake. There was no emergency. Shame on us. No more. Not buying the Alien Enemies Act. Now is the time to take to the streets, people. https://hotbuttons.substack.com/p/alien-enemies-act-of-1798-invoked?r=3m1bs

Who is "we"? I had no choice in the matter. You're right, we need to go to the streets, to give the courts the courage to protect us.

The Democrats tried to challenge this declaration but were thwarted by an obscure procedural motion tabled by House Republicans - https://www.nytimes.com/2025/03/11/us/politics/trump-tariffs-house-gop-vote.html?searchResultPosition=1

The House has no play here. The courts will takeover on the Aliens Act. The CR lets the Emergencies act stand pat. .

It would appear so. Some the arguments offered yesterday by the administration for their failure to compy with judge Boasberg's order to turnback the deportation flights to El Salvador were preposterous. They first claimed that the order as written didn't specifically mention turning back the planes; the judge's oral direction to this effect carried less weight than the written order (i.e. no weight at all). The planes were already over international waters when the order was received so it had no lawful effect. Trump's ditzy press secretary had earlier claimed that it was not lawful for a single judge in a single city to countermand a foreign policy decision of the president - as though some sort of quorum of judges were needed. The Hill reports that Trump's border czar more accurately expressed the administration's views in an interview with Fox & Friends (that's the Murdoch people not characters out of Kenneth Grahame). He told them: “I’m proud to be a part of this administration. We’re not stopping. I don’t care what the judges think. I don’t care.” The administration's position is utterly absurd and insolent yet the judge has so far declined to use his wide powers of contempt. - https://thehill.com/homenews/administration/5198604-border-czar-trump-deportation/

It was interesting the judge took in this information with little response. He indicated he had to write it up. It will be difficult to write. He has to be dead on. I know what I would do. Summon them all for the order reading, cite them for civil contempt, then haul them straight to the DC jail to be held until all deportees are returned. It is within the court’s discretion.

It's probably what he would like to do, but he's chosen instead to place the administration in the awkward position of having to defend its decision on proper legal grounds, something I think will be beyond its capacity to do.

I believe a question we must ask is the following: "Where did Donald Trump get the power to do evil?"

Expand full comment

I think we already know the answer to that. The question that remains is where he gets the legal authority for many of his arbitrary decisions and that's rather more complex to answer.

If this litigation is sent to the Supreme Court I stress that the ironic situation is this.

Supreme Court Justice Alito was born in Trenton, New Jersey. He was the son of Samuel A. Alito Sr., a Calabrian IMMIGRANT from Roccella Ionica, Calabria, and Rose Fradusco, an Italian-American whose parents came from Palazzo San Gervasio in Basilicata. I am also from Trenton. His family attended the local Catholic Churches.

I hope that he can dig deep into his heart and remember how we benefited from a democracy that educated and protected us. Can we be sure that these people who are being treated with such disgrace are in fact criminals and that they will be provided with the right to due process? This president is out of control. I pray that Sam will do the right thing and stop this administration from abusing others.

We are not at war. But there are people who provoke abuse and incivility. Let's stop this before it affects you and me with a constitutional crisis.

A little footnote:

I learned early when playing golf with people of political or business persuasions, actually a Ford Executive in Toronto, who played golf with Henry Ford, senior and junior........ that you have to know when to let them win. I was not very good and well never had a chance, but I was honest and watched others do the kiss ass job of letting them win.

Sam Alito is with the billionaire’s and Humpty all the way, as is gift-crazy Clarence Thomas. They will never relent, also unlikely Kavanaugh and Gorsucks.

Do we know who these men are? Has any evidence of criminal behavior exist? Mahmoud Khalil supported Palestine through peaceful protest and he was jailed, but at least has a court appearance coming up. Time to donate to the ACLU.

Humpty Dumpty is too ignorant to understand the discrimination against all denominations (such as Palestinians, Muslims, and Arabs) is just as “antisemitic” as attacks and discrimination against Jewish people (observers of the Jewish religion and non-observers).
